1. Services
Deja Works provides creative and audio-related services, including (but not limited to) mixing, mastering, consultations, memberships, and other related creative services.
All services are provided on a best-effort basis according to the information supplied by the client.

2. Subscriptions and Memberships
Some services are offered via optional subscription or membership plans with recurring billing.
– Subscriptions are opt-in only.
– By subscribing, you authorise recurring charges at the stated price and frequency.
– Subscriptions can be cancelled at any time with no cancellation fees or penalties.
– Unless otherwise stated, access to subscription benefits continues until the end of the current billing period after cancellation.

3. Payments
Payments are processed securely via third-party providers, including PayPal (including PayPal Pay in 4), Stripe, Apple Pay, and Google Pay.
We do not store full payment card details. All amounts are listed in Australian Dollars (AUD) unless stated otherwise.

4. Fees, Charges & Refunds

4.i – Fees and Charges
All service and subscription prices are displayed on this website or agreed in writing prior to work commencing.
Fees are charged in advance unless otherwise stated. Prices may change, but active subscriptions are billed at the agreed rate until the next billing period.

4.ii – Refunds
Due to the nature of creative and digital services:
– Refunds are not guaranteed once work has commenced.
– Completed services, delivered files, and subscription fees already billed are generally non-refundable.
– Refund requests may be considered at our discretion in exceptional circumstances, such as duplicate charges or billing errors.

4.iii – Chargebacks and Payment Disputes
If you have a billing issue, you agree to contact us first before initiating a chargeback or payment dispute.
Unauthorised chargebacks may result in suspension or termination of services.

5. Turnaround Times and Revisions
Any provided turnaround times are estimates only and may vary depending on workload, project complexity, and client responsiveness.
Revision limits (if applicable) are outlined on the relevant service or subscription page. Additional revisions may incur extra fees.

6. Client Responsibilities
Clients agree to:
– Provide accurate and complete project information
– Supply files in usable formats
– Respond to communications promptly
– Delays caused by incomplete information or late responses may affect delivery timelines.

7. Intellectual Property and Copyright

7.i – Ownership
Unless otherwise agreed in writing:
– Clients retain ownership of all original materials they provide to us.
– Dejaworks retains ownership of any tools, templates, workflows, processes, and materials created independently by us and used to deliver the services.

7.ii – Licence to Use
By engaging our services, clients are granted a non-exclusive, non-transferable licence to use delivered work for its intended purpose, subject to full payment.

7.iii – Portfolio and Promotion
Dejaworks reserves the right to showcase completed work for portfolio, marketing, or promotional purposes, unless the client explicitly requests in writing that their work remain confidential.

7.iv – Infringement
Clients warrant that any materials they provide to Dejaworks do not infringe on third-party intellectual property rights.
Dejaworks will not be liable for any claims arising from infringement of third-party copyrights, trademarks, or other rights if such materials are provided by the client.

8. Third-Party Platforms and Services
Our services may rely on third-party platforms, plugins, or providers. We are not responsible for outages, changes, or issues caused by these third parties.

9. Limitation of Liability
To the maximum extent permitted by law, Deja Works will not be liable for any indirect, incidental, or consequential loss arising from the use of our website or services.
Our total liability for any claim is limited to the amount paid for the relevant service.

10. Changes to These Terms
We may update these Terms from time to time. Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law
These Terms are governed by the laws of South Australia, Australia.
